01 Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Mivisus ("the Service"), operated by Mivisus ("we", "us", "our"). By accessing or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Service.
02 Description of Service
Mivisus is a cloud-based video surveillance platform that allows users to stream USB and IP cameras to the cloud and monitor them remotely via a web browser. The Service consists of:
- The Mivisus desktop application (Windows and Linux), used to connect cameras and stream to the cloud
- The Mivisus web dashboard, accessible at mivisus.com, used to view live camera feeds
- Associated APIs, infrastructure, and support services
03 Account Registration
To use the Service, you must create an account by providing a valid email address and password. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Not share your account with any third party
- Be responsible for all activity that occurs under your account
04 Acceptable Use
You agree to use the Service only for lawful purposes. You must not use Mivisus to:
- Conduct surveillance of individuals without their knowledge or consent where required by law
- Monitor private spaces (such as bathrooms or changing rooms) without explicit consent
- Harass, stalk, threaten, or harm any individual
- Violate any applicable local, national, or international law or regulation
- Stream, store, or distribute illegal, harmful, or offensive content
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use automated tools to scrape, crawl, or overload our systems
05 Subscription and Payment
Mivisus offers a free trial period and paid subscription plans. By subscribing to a paid plan, you agree to:
- Pay all applicable fees as described on the pricing page at the time of subscription
- Provide valid payment information and authorize us to charge the applicable fees
- Accept that subscriptions renew automatically unless cancelled before the renewal date
- Understand that fees are non-refundable except as required by applicable law
We reserve the right to modify pricing at any time, with at least 30 days' notice for existing subscribers before any increase takes effect.
06 Your Content
You retain ownership of all video content streamed through the Service ("Your Content"). By using the Service, you grant Mivisus a limited, non-exclusive license to transmit and process Your Content solely for the purpose of providing the Service to you.
We do not permanently store your video streams unless a recording feature is explicitly activated by you. You are responsible for ensuring you have the right to capture and stream all content transmitted through the Service.
07 Service Availability
We strive to maintain a high level of availability but do not guarantee uninterrupted access to the Service. We may:
- Suspend or interrupt the Service for maintenance, updates, or security reasons
- Modify or discontinue features with reasonable notice where possible
- Terminate access to the Service entirely, with 30 days' notice to active subscribers
We are not liable for any loss or damage arising from service interruptions beyond our reasonable control.
08 Account Termination
You may close your account at any time directly from your profile page. We may suspend or terminate your account without notice if you:
- Violate these Terms or our Acceptable Use policy
- Engage in fraudulent, abusive, or illegal activity
- Fail to pay applicable subscription fees
Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days of termination, except where retention is required by law.
09 Intellectual Property
The Service, including its design, software, trademarks, and content (excluding Your Content), is the property of Mivisus and is protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the Service without our prior written consent.
10 Limitation of Liability
To the maximum extent permitted by applicable law, Mivisus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business arising out of or in connection with the use or inability to use the Service.
Our total aggregate liability to you for any claim shall not exceed the amount paid by you to Mivisus in the 12 months preceding the event giving rise to the claim.
11 Governing Law
These Terms are governed by and construed in accordance with the laws of France. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France, without prejudice to any mandatory consumer protection rights you may have under local law.
12 Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
